Under the Health and Safety at Work etc. Act 1974, businesses must protect people affected by their activities from health and safety risks, so far as reasonably practicable. Responsibility for managing powered gate risks may be transferred by contract. Managing agents’ legal duties therefore depend on their management agreement, making it essential to clearly define responsibilities and boundaries in service agreements.

Synopsis


During the summer of 2010 two children died after becoming trapped in powered gates. They were trapped because:

  • their presence at the closing edge was not detected; and
  • the closing force of the gate when they obstructed it was too high.
