From 1st of October 2007 in England and in Wales 1st October 2007 a summary of leaseholders' rights and obligations must accompany every demand for the payment of a service charge.
Synopsis
The wording of the summary is prescribed and must be followed. The Appendix contains the wording for the English version as at July 2013.
Leaseholders who receive demands for service charges without the summary will have the right to withhold payments until the demand is sent again with a summary.
The requirement also applies to rented properties paying a variable service charge (excluding local authorities).
From June 2009 the name of the Lands Tribunal in paragraph 6 of the summary was amended to the Upper Tribunal but not yet in Wales.
From July 1st 2013 the name of the Leasehold Valuation Tribunal was amended but not yet in Wales.
Managing agents should be aware that further reforms to service charge administration and transparency are set to be introduced through the Leasehold and Freehold Reform Act 2024 (LAFRA).
