A breach of lease occurs when one party acts in such a way that violates one or more of the terms within the lease. Breaches are not formally considered in any terms of severity, but the consequences of certain breaches are more serious than others.
How to consider whether a breach has occurred
The starting point in addressing a perceived breach is to review the lease. In many instances, it will be very clear that a breach has occurred and action can be taken.
In some circumstances, a breach is not so obvious. In those instances, professional legal advice may be necessary to avoid any counter claims for nuisance or otherwise.
