This guidance sets out the key requirements for managing fire safety in multi-occupied residential buildings. It has been updated to take account of the requirements of the Fire Safety Act 2021 and the Fire Safety (England) Regulations 2022. It is not in any way a full statement of what a managing agent should be aware of in respect of fire safety. It also signposts to guidance on best practice where this is available.
Synopsis
This guidance cover both the various types of building work that fall within the scope of the Building Regulations 20103 and the various routes to compliance. It is detailed and complex guidance because the Building Act 19842, the Building Regulations 2010 and other regulations that apply to the processes are themselves complex.
It is therefore expected that managing agents will develop their own policies and decision-making procedures for managing building work in the types of building they manage. These procedures will need to consider the level of autonomy, in relation to the procurement of building work, that they have within their management agreement, and whether this may result in them being considered a client under the regulations.
