Synopsis

The purpose of this note is to examine a range of legal and practical options available to managers in such circumstances. The same general points will apply to external common areas.

Given that the legal and the direct action options are fraught with potential difficulties it cannot be over emphasised that the best approach will always be to seek to negotiate a sensible, co-operative solution.

If negotiation fails, managers are urged to proceed with caution. If there is any doubt over the legality of any particular tactic, legal advice should be taken before any precipitate steps are taken.
